Terms and Conditions

1.1

The food supplied by Nutrigate is dietary and nutritious food prepared fresh on order. Some items may be semi-cooked or ready-to-eat.

1.2

Customers are advised to consume the food within the time frame mentioned on the packaging/website. Any consumption beyond such period is strictly at the Customer's risk.

1.3

As the food is perishable, no guarantee is provided against spoilage or contamination if not consumed within the recommended time.

2.1

Nutrigate provides food items as nutritional supplements for general health only.

2.2

The food is not medicine and is not intended to diagnose, treat, cure, or prevent any disease.

2.3

Customers are responsible for being aware of their own medical conditions and allergies before placing an order. Nutrigate shall not be liable for any allergic reactions, intolerance, or adverse health effects arising from consumption.

3.1

Any complaints relating to food quality, delivery, or service shall be raised within 24 hours of delivery. Complaints raised thereafter shall not be entertained.

3.2

Customers must provide appropriate evidence (photo/video) of the product at the time of receipt to support the complaint.

4.1

Orders once placed cannot be cancelled after food preparation has commenced.

4.2

Refunds shall be considered only in the following cases:

• Delivery of the wrong order; or
• Delivery of spoiled or unfit food at the time of receipt, duly supported by evidence.

4.3

Refunds will not be provided in the following cases:

• Change of mind after placing the order,
• Food consumed beyond the recommended time limit,
• Allergic or adverse reactions to food ingredients.

4.4

Approved refunds will be processed through the original payment method within 7–10 working days.

5.1

Nutrigate's liability, if established, shall be limited strictly to the amount paid by the Customer for the specific order.

5.2

Under no circumstances shall Nutrigate be liable for consequential, incidental, or indirect damages.

5.3

The pecuniary limit for damages arising from any order shall not exceed ₹5,000/- per order.

6.1

Nutrigate makes no express or implied warranties regarding the suitability, nutritional value, or health benefits of its food items.

6.2

No guarantee is made for curing illnesses, weight reduction, or other medical outcomes.

6.3

The results of consuming Nutrigate's food depend upon the Customer's overall lifestyle, health condition, and consistency in diet. Nutrigate provides no assurance or guarantee of specific results or outcomes.

7.1

Customer personal information including order history, delivery details, and dietary preferences shall be kept confidential and used only for providing services.

7.2

Nutrigate shall not disclose Customer information to third parties except as required by law or with explicit consent.

8.1

In case of disputes, parties shall first attempt amicable settlement through negotiation.

8.2

If unresolved within 30 days, the dispute shall be referred to arbitration in Calicut under the Arbitration and Conciliation Act, 1996, before a sole arbitrator mutually appointed by both parties.

8.3

The language of arbitration shall be English.

8.4

Subject to arbitration, the courts at Kozhikode, Kerala, shall have exclusive jurisdiction.

9.1

Any reward or promotional benefit offered by Nutrigate shall be claimed within 5 days of the maturity of the offer.

9.2

In case of periodic rewards such as monthly rewards, the same shall be redeemed within 5 days of the respective date.

9.3

Customers subscribing to a monthly plan may pause their subscription for a maximum of 3 days in a month.

9.4

There is no pause option available for weekly subscribers.

9.5

Any request for pause in subscription must be communicated to Nutrigate at least 48 hours in advance.

10.1

Nutrigate reserves the right to modify these Terms without prior notice. Updated Terms will be published on the website and shall apply prospectively.

10.2

By ordering, You confirm that You are of legal age (18 years or above) and capable of entering into a binding agreement.

10.3

These Terms constitute the entire agreement between Nutrigate and the Customer.
